ORGANIC POULTRY

Organic guidelines are based on the USDA organic regulations (7 CFR §205).
In order to be eligible for organic certification, farms must be in compliance with the following standards Poultry – Guidelines

Organic Poultry Plan Application
Please fill out this form if you are requesting organic certification or re-certification of poultry for slaughter or egg production.
A separate organic Farm Plan Questionnaire must be filled out if you are growing your own feed or other organic crops for
sale. Use additional sheets if necessary. Attachments required with questionnaire: Directions to your farm/ranch operation;
farm map showing all poultry houses and outdoor access areas; Outdoor Access/Pasture History Sheet; and water test, if
applicable.

STARTING A POULTRY/RABBIT BUSINESS OR  FARM STAND

The Secretary of State is where you register your business name (Entity) and protect any trade names or  trademarks.  

Filing a Trade Name with the Oklahoma Secretary of State will protect the use of your business name within Oklahoma. The filing will also check for conflicts with existing Oklahoma businesses.

Business Licenses + Permits

In Oklahoma, there is no license required just to start or own a business, but there are specific licenses and permits for different industries and business activities.

The terms license and permit are often used by different government agencies, cities and towns to mean a qualification or permission from an authority to engage in some kind of activity. 

Some of these licenses or permits apply to individuals, companies, or the types of items being sold or services being offered. 

 

Sales Tax Permit

One of the most common permits is the sales tax permit. It is required for retailers, resellers, or others that sell tangible property on an ongoing basis. 

Obtain a sales tax permit from the Oklahoma Tax Commission.

Other Permits

All businesses with employees (including those under the structure of a sole proprietorship) must obtain an Employer
Identification Number (EIN) with the IRS. An EIN is free to obtain and may be filed electronically in most cases.

Federal Employer Identification Number

The federal EIN isn’t just for businesses with employees. Your accountant may recommend that you establish an EIN for your business and your bank may require one to set up business banking accounts and services.

All employers must obtain a Federal Employer Identification Number, so if you will have employees, you must file for an EIN.

A sales tax permit is needed if you are selling tangible personal property for monetary or other consideration on an ongoing basis. All consideration received for the sale is included in gross receipts subject to tax.

“Tangible personal property” is that which can be seen, weighed, measured, felt or touched or that is in any other manner perceptible to the senses.

Sales Tax Permit

One of the most common permits is the sales tax permit. It is required for retailers, resellers, or others that sell tangible property on an ongoing basis. 

Obtain a sales tax permit from the Oklahoma Tax Commission.

If you are selling your Poultry and Rabbit meat you will need to fill out this one page “FREE” Application available in a PDF download Application-of-Registration-for-Distributors-Meat-Brokers-and-Public-Warehousemen-Fillable or download it from the ODAFF website.  You will need to return the form to ODAFF.  ODAFF will issue a permit.

Employer Responsibilities

 

Income Tax Withholding

Employers must set up a withholding account for state income taxes through the Oklahoma Tax Commission

The Internal Revenue Service requires employers to have an EIN and withhold income and payroll taxes for their employees.

Unemployment

You will need to set up an account for employees’ unemployment taxes through the Oklahoma Employment Security Commission.

 

Workers’ Compensation

Obtain a workers’ compensation insurance policy through a private insurer.
